Not if you consider a local judge has twice now dismissed a petition filed to remove the district attorney from office.
A group of six residents first filed a petition on June 19, to oust Victoria County District Attorney Steve Tyler.
Petitioners claim Tyler is guilty of official misconduct, oppression and incompetence, among other claims.
District Judge Stephen Kemper Williams dismissed that petition because residents filed it wrong.
So, the petitioners revamped their petition and re-filed it Thursday morning under the proper local government code.
Williams needed less than three hours to dismiss it a second time.
In an order filed at 2:10 p.m., Williams simply noted that after reviewing the petition again he dismissed it.
Ernie Cash, the petitioners’ spokesman, said he sees no reason to re-file a petition a third time.
“Well, I seriously doubt it. The group, they may have other opinions, but I don’t think we should,” Cash said. “If the judge didn’t state any specific grounds, I can only assume he dismissed it on its merits.”
Tyler, who has said all along that the petition is frivolous and fraught with legal inaccuracies, offered similar thoughts on Thursday.
“I think they actually believed that I’m scared or that this is causing me some worry,” Tyler said. “I ain’t worried.”
Williams, the judge, won’t talk about the petition.
Cash, though, said the group did not introduce new information to the petition. A week ago, the group said it may do so.
Cash declined to say what this information is.
He did say that Williams’ quick dismissal surprised him.
“I don’t see why he dismissed it, but c’est la vie,” Cash said.
