• Of course this case should be summarily dismissed by the judge, but what is a judge before and after being a judge? You guessed it: a lawyer.
    A prominent trial lawyer in town once said when it comes down to being between making money and legal ethics the ethics have to go everytime. One of the biggest oxymorons in the world is the term "legal ethics". The cause of most human misery and government waste can be directly attributed to lawyers. Shakespeare had it right centuries ago when one of the characters in one of his plays said, "The first thing we do is kill all the lawyers". Had they followed his advice then we would all be better off now.

  • waywardwind, you have a good point. If the ambulance chaser were on the hook for the defendant's costs, that would solve the problem, regardless of his ethics or lack thereof.

  • These vehicles are not designed to transport people. So this claim is absolutely retarded. The immigrants knew the danger the were putting themselves in and did it anyways. It is sad, but it their actions that lead to their demise.

  • Observer...I can understand the plaintiffs wanting to sue. An honest, ethical lawyer would tell them when they don't have a reasonable case and not take it. I think the lawyers who file these types of harassing lawsuits should pay when they LOSE.

  • This is the best argument I have seen in quite some time for a change to the English System for civil suits. If the loser has to pay, inane, insane suits such as this would never be filed.

  • ajt20m...Nah, the judge won't dismiss. He's a lawyer and other lawyers contribute to his re-election fund. The judge would be afraid that the lawyers would cut him off and support somebody who WOULD allow such cases to go through. This will be a total waste of tax dollars. When this case is finished, Delgado should be required to repay the state for the court costs and the companies for their defense costs. I'm trying REAL hard here to see Delgado as a member of a noble profession. It just ain't happenin'.

  • Wow! Can't believe what I am reading. I am saddened of the events that led to this lawsuit. However everyone in this situation was a criminal. It's sad that the familes are most likely going to profit off of their families criminal activity.

  • This,by far, is the most absurd thing I've read today. Everyone in the world seems to be sue happy lately, even the criminals or family of the criminals, in this case.

    While I have compassion for the families of the people who died, they died while commiting a crime.

    The focus seems to have always been on the illegal activity of the driver of the truck and the people behind the transport of these people but the bottom line is these people climbed into this trailer knowing that what they were doing was illegal.

    Sueing the maker of the trailer is just plan dumb. Nearly as dumb as crawling into the back of a tractor trailer and paying strangers to take you to the promised land.
